Terms and conditions for using Degluwhitt's energy services

1. About These Terms

These Terms of Service ("Terms") govern your use of electricity and gas supply services provided by Degluwhitt Limited, a company registered in England and Wales (Company Number: 12345678) with its registered office at 123 Energy Street, London EC2V 8AB ("Degluwhitt," "we," "us," or "our").

By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our services.

2. Definitions

  • "Customer" means the person or entity who has entered into an agreement with us for the supply of energy
  • "Premises" means the property to which we supply energy
  • "Supply Agreement" means the contract between you and us for the supply of energy
  • "Tariff" means the prices and charges for our services
  • "Force Majeure" means circumstances beyond our reasonable control

3. Service Provision

3.1 Energy Supply

We will supply electricity and/or gas to your premises in accordance with:

  • These Terms
  • Your Supply Agreement
  • Applicable industry standards and regulations
  • Our Standard Terms and Conditions

3.2 Service Availability

We aim to provide uninterrupted energy supply, but we cannot guarantee continuous supply due to:

  • Maintenance and repair work
  • Network failures
  • Emergency situations
  • Force Majeure events
  • Regulatory requirements

4. Customer Obligations

4.1 Payment of Bills

You must:

  • Pay all charges on time as specified in your bill
  • Provide accurate meter readings when requested
  • Allow safe access to meters and equipment
  • Notify us of any changes to your circumstances
  • Use energy responsibly and legally

4.2 Property Access

You must provide us or our authorized representatives with reasonable access to:

  • Read meters
  • Inspect equipment
  • Carry out maintenance
  • Install or remove equipment
  • Investigate safety concerns

4.3 Safety Obligations

You must:

  • Report any gas leaks or electrical hazards immediately
  • Not interfere with meters or equipment
  • Ensure electrical and gas installations are safe
  • Comply with relevant safety regulations

5. Pricing and Payment

5.1 Tariffs and Charges

Our charges include:

  • Unit rates for energy consumption
  • Standing charges
  • Taxes and levies as required by law
  • Additional services as requested

5.2 Price Changes

We may change our prices in accordance with:

  • Regulatory requirements
  • Changes in wholesale energy costs
  • Changes in taxes or levies
  • Our Standard Terms and Conditions

5.3 Payment Terms

Bills are due within 14 days of the bill date unless otherwise agreed. Late payment may result in:

  • Late payment charges
  • Credit control action
  • Referral to debt collection agencies
  • Termination of supply

6. Liability and Limitation

6.1 Our Liability

Our liability to you is limited as follows:

  • We are not liable for supply interruptions due to circumstances beyond our control
  • Our total liability is limited to the amount you have paid us in the 12 months prior to the claim
  • We exclude liability for indirect or consequential losses
  • Nothing excludes our liability for death, personal injury, or fraud

6.2 Your Liability

You are liable for:

  • All energy consumed at your premises
  • Damage to our equipment caused by you
  • Costs arising from your breach of these Terms
  • Safety violations at your premises

7. Data Protection and Privacy

We process your personal data in accordance with:

  • UK GDPR and Data Protection Act 2018
  • Our Privacy Policy
  • Industry codes and standards
  • Regulatory requirements

8. Termination

8.1 Termination by You

You may terminate our services by:

  • Giving us 30 days' written notice
  • Switching to another supplier
  • Closing your account

8.2 Termination by Us

We may terminate our services if:

  • You breach these Terms
  • You fail to pay bills after notice
  • You deny us access to your premises
  • We are required to do so by law

8.3 Effects of Termination

Upon termination:

  • You must pay all outstanding charges
  • We may remove our equipment
  • Your account will be closed
  • These Terms will continue to apply to any outstanding obligations

9. Complaints and Disputes

9.1 Complaint Procedure

If you have a complaint:

  • Contact our customer service team first
  • We will investigate and respond within 8 weeks
  • If unresolved, you may refer to the Energy Ombudsman

9.2 Alternative Dispute Resolution

For unresolved complaints, you may contact:

10. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including:

  • Network failures
  • Cyber attacks
  • Pandemic or health emergencies

11. Intellectual Property

All intellectual property rights in our services, website, and materials belong to us or our licensors. You may not:

  • Copy or reproduce our materials without permission
  • Use our trademarks or logos
  • Reverse engineer our systems
  • Create derivative works

12. Regulatory Compliance

Our services are subject to regulation by:

  • Ofgem (Office of Gas and Electricity Markets)
  • Health and Safety Executive
  • Environment Agency
  • Local authorities

We will comply with all applicable regulations and industry standards.

13. Changes to Terms

We may update these Terms by:

  • Giving you 30 days' notice for material changes
  • Posting updated Terms on our website
  • Including notice in your bill
  • Sending email notification

Continued use of our services after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Governing Law

These Terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the English courts.

16. Entire Agreement

These Terms, together with your Supply Agreement and our Standard Terms and Conditions, constitute the entire agreement between us and supersede all prior agreements and understandings.
